If you are or are not please be so kind as to post the Adaptec Part Number including any rev numbers so others here will be able to tell what they are getting. Sadly the only way to know for sure is to test it you should know fairly quickly whether you are all good. If the new chipset does address this problem you may well be alright. I don't know whether Adaptec have resolved the the bus link timing problem evident in the NEC two chip designs. Many implementers provide only 2 ports based on the TI reference design as it provides the highest degree of compatibility and device support.
